My promise to you is to make every attempt to keep your
Web costs low without compromising quality. I also promise to be honest
straight and forward about how we do business. My goal is to treat you
as a respected partner as we work together to add value to your
business.
Work Authorization
Before I perform work for you, I will submit a work proposal and
estimate to you by email. I will ask you to authorize the work or revise
the proposal and then authorize the work. This process enables you to
know what I am about to do and how much it will cost. You are encouraged
to set spending limits. If I approach a spending limit, I will inform
you before the limit is reached. This process enables you to control
your expenses and keep your business profitable.
Billable Hours
Billable hours are hours that I spend working on your project. This
includes Web site development, telephone calls, emails, meetings, and
other time related to your project. Time is billed in half hour
increments. This is an area that requires some responsibility on your
part. For example, if you call me to ask a simple question that may only
take a few minutes to answer, you will still be billed for a half hour.
If we talk on the phone for 45 minutes, you will be billed for an hour.
If you send me an email with a simple question that can be answered in a
few sentences, that email reply will be billed at the half hour minimum.
To help keep your costs low, collect a group of small questions
before calling or sending an email. However, if you have an emergency,
you should call me anytime.
Web sites require almost constant revision. They are live documents.
It is common for new Web publishers to revise their Web sites several
times a day. For me to make the revisions for them, represents
significant income. For them, it represents out of control costs. My
goal is to teach you how to revise your Web site yourself, so that you
will feel encouraged to revise it often.
Billing Cycle
You will be billed at the end of a month for the prior month’s hours
and fees. Payment is due within 10 days of your receipt of the bill.
Your bill will be sent to you electronically. Past due accounts,
exceeding 30 days, will result in cessation of services including Web
and email.
Working Hours
I work between 8:00 a.m. and 5:00 p.m. Monday through Friday. If I am
out of the office working with another client on-site, I will not be
accessible by phone, but I will return your call as soon as possible.
You will be notified if I am not going to be available for extended
periods such as out of town assignments and vacations.
Liability
At some time in the future, your Web hosting service will go off
line. They may be off line for 1 hour to a day. During the time that
their system is down no one will be able to access your Web site. When
this happens, you may lose your email access through your domain name
account. I accept no liability for your Web hosting and email service
not providing you with service. If you require 100% up time for your Web
site and email, that level of reliability is available, but at
considerable additional expense. In these uncertain times, no one can
predict when a business will fail. If your Web hosting service goes out
of business, I do not accept any liability associated with the business
closure.
If I make a mistake I will correct that mistake, but I will not
accept liability for losses incurred as a result of that mistake.
Whenever I perform work on your Web site, I will ask you to review the
work to ensure that no mistakes exist. Even with both of us examining
your Web site, we may miss something that a customer will find. If the
mistake is mine I will correct it without charge, but that will be the
limit of my liability. All Web sites go through a debugging process
before and after they are published. It is rare for a Web site to be bug
free. As the number of pages increase, so does the potential for bugs.
As you take greater control over your Web site you will make
mistakes. Mistakes made by you are your responsibility even if those
mistakes are the result of omission of instruction. Although I will try
to keep you informed, I can’t tell you everything you need to know to
avoid making mistakes. Again, I accept no liability for this type of
problem.
I accept no liability for the content of your Web site. If a customer
of yours should file legal action against you regarding content
published on your Web site, the responsibility for the content is
entirely yours.
If your Web site requires work done by an outside contractor, the
business relationship is between you and the contractor. I accept no
liability for work done by outside contractors such as database
programmers, graphic designers, or other professionals. If you contract
with an ecommerce programmer and your shopping cart fails to function,
you must work out the problem with the ecommerce programmer directly. I
will volunteer to mediate, but I will not accept responsibility for the
outcome.
Copyrighted work must have the permission of the copyright holder
before being published on your Web site. For example, if you hire a
graphic designer to design your stationary, you must obtain their
permission to publish the same designs to your Web site. If you wish to
publish an article you wrote for a national magazine or newspaper to
your Web site, you must have permission from the publisher to reproduce
that work on the Web. I accept no liability for your publication of
copyrighted materials.
Reserved Rights
I reserve the right abandon Web site projects dealing with
pornographic content, politically extremist content, or Web sites with
criminal intent. If an existing client changes the content of their Web
site in such a way as I deem objectionable I will stop work on that
project and accept no liability for unfinished work or canceled
commitments.
